House Bill 847

AN ACT TO REQUIRE THAT INSURERS SHALL PROVIDE MEDICAL MALPRACTICE INSURANCE COVERAGE TO ANY HEALTH CARE PROVIDER WHO MEETS THE QUALIFICATIONS OF THE INSURER; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  For purposes of this section, "insurer" means an issuer of insurance policies or plans providing medical malpractice insurance coverage to licensed physicians, hospitals or other licensed health care providers in the State of Mississippi.

     (2)  Any licensed physician, hospital or other licensed health care provider may apply for medical malpractice insurance coverage with an insurer.  If the insurer determines that the applicant meets the underwriting standards of the insurer and there is no unpaid, uncontested premium due from the applicant for prior insurance, then the insurer, upon receipt of the premium, shall cause to be issued a policy of medical malpractice insurance.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2004.
