House Bill 779

AN ACT TO REPEAL SECTION 99-19-61, MISSISSIPPI CODE OF 1972, WHICH PROVIDES THAT THE COMMISSIONER OF CORRECTIONS IS AUTHORIZED TO PAY COSTS OF A TRIAL OR COSTS FOR AN EXECUTION FOR AN INMATE WHO COMMITS A CRIME WITHIN THE CONFINES OF THE PENITENTIARY OR FOR A CRIME COMMITTED BY AN INMATE OUTSIDE THE CONFINES OF THE PENITENTIARY; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 99-19-61, Mississippi Code of 1972, which provides that the Commissioner of Corrections is authorized to pay out of any available departmental funds all lawful costs, fees or expenses associated with the trial, or eventual execution, of an inmate who commits a crime within the confines of the Penitentiary  or commits any crime outside the bounds of the Penitentiary, is repealed.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2004.
