AN ACT TO REQUIRE PROFESSIONAL BAIL AGENTS, SOLICITING BAIL AGENTS AND BAIL ENFORCEMENT AGENTS TO REPORT TO THE COMMISSIONER OF INSURANCE ANY ADMINISTRATIVE OR CRIMINAL ACTION INITIATED AGAINST THEM; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1. (1)  A professional bail agent, soliciting bail agent or bail enforcement agent, as defined in Section 83-39-1, who is licensed under Section 83-39-3, shall report to the Commissioner of Insurance any administrative action taken against him in another jurisdiction or by another governmental agency in this state within thirty (30) days of the final disposition of the matter.  This report shall include a copy of the order, consent to order or other relevant legal documents.

     (2)  Within thirty (30) days of the initial pretrial hearing date, the bail agent licensee shall report to the commissioner any criminal prosecution of the licensee taken in any jurisdiction.  The report shall include a copy of the initial complaint filed, the order resulting from the hearing and any other relevant legal documents.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2004.
