AN ACT TO PROVIDE THAT IT IS UNLAWFUL FOR ANY PERSON TWENTY-ONE YEARS OF AGE OR OLDER TO DRIVE OR OTHERWISE OPERATE A VEHICLE IN VIOLATION OF THE IMPLIED CONSENT LAW WITH A VEHICLE OCCUPANT WHO IS UNDER TWENTY-ONE YEARS OF AGE; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  It is unlawful for any person Twenty-one (21) years of age or older to drive or otherwise operate a vehicle in violation of subsection (1) of Section 63-11-30, with a vehicle occupant who is under Twenty-one (21) years of age.

     (2)  A violation of subsection (1) of this section shall constitute an offense separate and in addition to an offense under Section 63-11-30 or any other offense, violation of which shall constitute a misdemeanor punishable, upon conviction, by a fine of not more than One Thousand Dollars ($1,000.00), by imprisonment for not more than one (1) year, or by both such fine and imprisonment.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2004.
