House Bill 368

AN ACT TO AMEND SECTION 49-7-61, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT IT IS UNLAWFUL FOR ANY PERSON TO HUNT WITHIN THREE HUNDRED YARDS OF ANY DWELLING HOUSE; TO PRESCRIBE PENALTIES FOR VIOLATIONS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 49-7-61, Mississippi Code of 1972, is amended as follows:

     49-7-61.  (1)  If any person shall hunt within one-fourth (1/4) mile of any church on Sunday while worship services are being held, he shall, on conviction be fined not less than Twenty-five Dollars ($25.00) nor more than One Hundred Dollars ($100.00).

     (2)  It is unlawful for any person to hunt within three hundred (300) yards of any dwelling house or any other building usually occupied by persons, whether actually occupied or not.  Any person who violates this subsection shall be punished, upon conviction, by a fine of not more than One Thousand Dollars ($1,000.00), by imprisonment in the county jail for not more than one (1) year, or by both such fine and imprisonment.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2004.
