House Bill 54

AN ACT TO PROHIBIT A BUSINESS IMPROVEMENT DISTRICT FROM TAKING ANY ACTION THAT WILL IMPEDE, CIRCUMVENT OR SUPERSEDE THE AUTHORITY OF A MUNICIPALITY IN WHICH SUCH A DISTRICT IS LOCATED; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Any business improvement district established or extended under the provisions of Sections 21-43-101 through 21-43-133, shall not take any action that will impede, circumvent or supersede the authority of a municipality in which such a district is located.   

     SECTION 2.  Section 1 of this act shall be codified as a separate code section in Chapter 43, Title 21, Mississippi Code of 1972.

     SECTION 3.  This act shall take effect and be in force from and after July 1, 2004.
