AN ACT TO AUTHORIZE THE BOARD OF SUPERVISORS OF DESOTO COUNTY, MISSISSIPPI, TO ENTER INTO AGREEMENTS TO ALLOW THE USE OF SURPLUS REAL PROPERTY OF THE COUNTY RENT FREE BY A NONPROFIT ORGANIZATION WHICH PROVIDES FOOD TO THE NEEDY; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The Board of Supervisors of DeSoto County, Mississippi, is authorized to enter into agreements to allow the use of surplus real property of the county rent free by a nonprofit organization which provides food to the needy.  Only property that has been declared by the county in its minutes to be surplus property may be utilized for such purposes.  Any nonprofit organization utilizing any such property shall sign a hold harmless agreement holding the county harmless from any damages or claims.  The nonprofit organization shall be responsible for utilities and any improvements to the property.  The term of an agreement entered into under this act shall not exceed one (1) year.  The board of supervisors may extend the agreement for successive periods that do not exceed one (1) year.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
