AN ACT TO AUTHORIZE THE GOVERNING AUTHORITIES OF THE CITY OF OKOLONA, MISSISSIPPI, TO ASSESS ADDITIONAL COURT COSTS ON EACH MISDEMEANOR CASE FILED IN THE MUNICIPAL COURT OF SUCH MUNICIPALITY FOR THE PURPOSE OF FUNDING THE DRUG ABUSE RESISTANCE EDUCATION PROGRAM OR SIMILAR PROGRAM; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The governing authorities of the City of Okolona, Mississippi, are authorized and empowered, in their discretion, by resolution duly adopted and entered on its minutes, to levy an additional assessment, in addition to any other assessments and court costs, on each misdemeanor case filed in the municipal court in such municipality, in the following amounts:

          (a)  Upon each person convicted under the Controlled Substances Law, Ten Dollars ($10.00).

          (b)  Upon each person convicted under the Mississippi Implied Consent Law, Ten Dollars ($10.00).

          (c)  Upon each person convicted of all other misdemeanors, Five Dollars ($5.00).

     (2)  The avails of the additional assessment imposed pursuant to subsection (1) of this section shall be expended by the city to fund a Drug Abuse Resistance Education Program or similar programs designed to deter the abuse of drugs in the City of Okolona.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
