AN ACT TO MAKE IT UNLAWFUL TO PLACE A CONCENTRATED ANIMAL FEEDING OPERATION WITHIN THE ONE HUNDRED-YEAR FLOODPLAIN OF THE WATERS OF THE STATE; TO PROVIDE PENALTIES; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  It is unlawful for any person to construct or operate a concentrated animal feeding operation within the one hundred-year floodplain of any waters of the state.

     (2)  Any concentrated animal feeding operation constructed in a floodplain prior to July 1, 2003, is exempt from this section.

     (3)  Any person found by the Commission on Environmental Quality to be in violation of this section shall be subject to the penalties provided in Section 49-17-43.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
