House Bill 1557

AN ACT TO AUTHORIZE THE GOVERNING AUTHORITIES OF THE CITY OF OKOLONA, MISSISSIPPI, TO LEVY AN ASSESSMENT, IN ADDITION TO ANY OTHER ASSESSMENTS AND COURT COSTS, FOR EACH MISDEMEANOR CONVICTION OBTAINED IN ITS MUNICIPAL COURT(S) AND FOR EACH DRIVING UNDER THE INFLUENCE AND DRUG/PARAPHERNALIA CHARGE IN THE MUNICIPAL COURT(S); TO PROVIDE THAT THE AVAILS OF THE ADDITIONAL ASSESSMENT SHALL BE USED FOR THE SUPPORT OF THE NONPROFIT ORGANIZATION D.A.R.E.; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The governing authorities of the City of Okolona, Mississippi, in their discretion, by resolution duly adopted and entered on the minutes of the governing authorities, may levy an assessment, in addition to any other assessments and court costs, not to exceed Five Dollars ($5.00) per case, for each misdemeanor conviction obtained in any municipal court of the City of Okolona.

     (2)  The governing authorities of the City of Okolona, Mississippi, in their discretion, by resolution duly adopted and entered on the minutes of the governing authorities, may levy an assessment, in addition to any other assessments and court costs, not to exceed Ten Dollars ($10.00) per case, for each Driving Under the Influence (D.U.I.) charge and drug/paraphernalia charge in any municipal court of the City of Okolona.

     (3)  The avails of the additional assessment imposed under subsections (1) and (2) of this section shall be expended by the City of Okolona to support the nonprofit organization, D.A.R.E., for the benefit of crime prevention and drug education programs developed by the Okolona Police Department.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
