House Bill 1426

AN ACT TO AUTHORIZE THE LEASING OF A TRACT OF LAND FROM THE MISSISSIPPI FAIR COMMISSION TO HOMER'S BARBEQUE; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The Mississippi Fair Commission is hereby authorized to lease a tract of land on the Mississippi State Fairgrounds in Jackson, Mississippi, to Homer Hutzel doing business as Homer's Barbeque for a term of one (1) year.  The property has an area of four thousand nine hundred fifty (4,950) square feet more or less, with dimensions of ninety-nine (99) feet of frontage along the south side of High Street and a depth of fifty (50) feet, more or less, and being located between Greymont Street and the north entry drive to the Mississippi Coliseum.  An exact legal description and survey shall be provided by Homer's Barbeque before the execution of the lease.

     The monthly rentals shall be Two Hundred Forty Three Dollars ($243.00), payable in advance to the Mississippi Fair Commission.  Homer's Barbeque shall reimburse the Mississippi Fair Commission for the cost of the appraisal prepared on December 4, 2002, of this property.  The Mississippi Fair Commission shall have the option of renewing the lease on an annual basis for two (2) additional years upon the completion of the primary term.  The monthly rentals for any renewal of the lease shall be an amount agreed upon by the Mississippi Fair Commission and Homer Hutzel doing business as Homer's Barbeque.  Any one (1) of the commissioners of the Mississippi Fair Commission shall be authorized to execute the lease on behalf of the commission.  Homer's Barbeque shall pay all ad valorem taxes and any other taxes and assessments that may be levied upon the property during the term of the lease, if any.  The property may be used only as a parking lot to serve the customers of Homer's Barbeque.  The lease shall contain such other terms and conditions that may be agreed upon by the parties.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2003.
