AN ACT TO AUTHORIZE THE DEPARTMENT OF FINANCE AND ADMINISTRATION TO CONVEY TO THE MISSISSIPPI DEPARTMENT OF AGRICULTURE AND COMMERCE CERTAIN STATE-OWNED REAL PROPERTY IN THE CITY OF JACKSON, MISSISSIPPI, FOR USE AS ADDITIONAL STATE FAIRGROUNDS; TO AUTHORIZE THE MISSISSIPPI EMPLOYMENT SECURITY COMMISSION TO TRANSFER TO THE DEPARTMENT OF FINANCE AND ADMINISTRATION CERTAIN REAL PROPERTY LOCATED IN THE CITY OF JACKSON, HINDS COUNTY, MISSISSIPPI; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The Department of Finance and Administration is hereby authorized and empowered to transfer to the Mississippi Department of Agriculture and Commerce certain state-owned real property, and any improvements located thereon, being situated in the City of Jackson, First Judicial District of Hinds County, Mississippi, and more particularly described as follows to wit:

Beginning at the intersection of the east right-of-way line of the abandoned Illinois Central Gulf's 100-foot railroad right-of-way and the east right-of-way line of Jefferson Street, proceed in a northerly direction along the east right-of-way of Jefferson Street to a point on the south right-of-way line of High Street; thence turning through a 90 degree angle, run easterly along the south right-of-way line of High Street to a point on the east right-of-way line of the Illinois Central Gulf's abandoned railroad; thence run southwesterly along the east line of the said right-of-way to the west right-of-way line of Camp Street; thence run south along the west right-of-way line of Camp Street to a point on the north right-of-way line of Mississippi Street; thence turning through a 90 degree angle, run westerly to the point of beginning, being a parcel of land containing 6.3 acres more or less.

     (2)  It is the intent of the Legislature that the Department of Archives and History will continue to operate the State Records Center on the property described in subsection (1) of this section with complete vehicular access available to the center until such time as a new State Records Center can be constructed or otherwise provided.  The Department of Archives and History shall not be required to pay rent or lease payments for use of the property presently occupied by the State Records Center.

     SECTION 2.  (1)  The Mississippi Employment Security Commission, in its discretion, may transfer and convey to the Department of Finance and Administration, all right, title and interest in and to certain real property and any improvements thereon located in the City of Jackson, Hinds County, Mississippi, subject to any encumbrances, liens, covenants, conditions or restrictions pertaining thereto, such property described more particularly as follows: 

A certain parcel of land being situated in Section 4, T5N-R1E, and in Section 33, T6N-R1E, Jackson, Hinds County, Mississippi, and being more particularly described as follows:

Beginning at the Northwest corner of the Northeast 1/4 of the Northwest 1/4 of Section 4, T5N-R1E and run thence North 00 degrees 05 minutes 00 seconds West for a distance of 480.58 feet to Capers Street (as not laid out and improved, November, 1989); said point being the Point of Curvature of a 9.919 degree curve to the left having a radius of 577.63 feet and a central angle of 54 degrees 10 minutes 18 seconds; run thence southeasterly along the arc of said curve for an arc distance of 546.14 feet; said arc having a chord bearing of South 27 degrees 07 minutes 00 seconds East and a chord distance of 526.02 feet to the Point of Tangency; run thence South 54 degrees 09 minutes 00 seconds East along the southerly line of Capers Street for a distance of 302.43 feet; leaving the southerly line of said Capers Street, run thence South 32 degrees 54 minutes 00 seconds West along the West line of the Boy's Club of Jackson property for a distance of 709.99 feet to the northerly line of West Capitol Street (as now laid out and improved, November, 1989); run thence westerly along the North line of West Capitol Street the following bearings and distances:  North 51 degrees 24 minutes 00 seconds West for a distance of 28.08 feet; North 50 degrees 13 minutes 18 seconds West for a distance of 113.00 feet; North 52 degrees 00 minutes 24 seconds West for a distance of 139.00 feet; leaving said North line of West Capitol Street, run thence North 34 degrees 50 minutes 00 seconds East for a distance of 215.94 feet; run thence North 00 degrees 30 minutes 00 seconds West for a distance of 408.25 feet in the POINT OF BEGINNING, containing 282,446.68 square feet or 6.484 acres, more or less.

     (2)  The conveyance authorized in this section may be made on such terms and conditions agreed upon by the Mississippi Employment Security Commission and the Department of Finance and Administration. 

     (3)  The Department of Finance and Administration shall assume all supervision, management, maintenance and control of the property described in subsection (1) of this act.

     (4)  Any funds received by the Mississippi Employment Security Commission for the conveyance of the property described in subsection (1) of this section may be used to defray the costs of construction of a new building and related facilities for the Mississippi Employment Security Commission. 

     SECTION 3.  This act shall take effect and be in force from and after its passage.
