AN ACT TO AMEND SECTION 41-29-133, MISSISSIPPI CODE OF 1972, TO ALLOW CERTAIN AGENCIES AND BOARDS TO INSPECT RECORDS PERTAINING TO CONTROLLED SUBSTANCES; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1. Section 41-29-133, Mississippi Code of 1972, is amended as follows:

     41-29-133.  Persons registered to manufacture, distribute, or dispense controlled substances under this article shall keep records and maintain inventories in conformance with the record-keeping and inventory requirements of federal law and with any additional rules the State Board of Pharmacy, the State Board of Medical Licensure, the State Board of Dental Examiners or the Mississippi Board of Nursing may issue.

     Upon production of proper and valid credentials, all records pertaining to controlled substances shall be made available for inspection, copying, downloading or removal for investigative purposes by agents or investigators of the Mississippi State Board of Pharmacy, Mississippi Bureau of Narcotics, Mississippi State Board of Medical Licensure, Mississippi Board of Nursing, Mississippi State Board of Dental Examiners or any other law enforcement officer authorized to enforce provisions of this chapter.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2003.
