AN ACT TO PROHIBIT THE USE OF ALL-TERRAIN VEHICLES ON PUBLIC HIGHWAYS, ROADS AND STREETS IN THE STATE OF MISSISSIPPI; TO PROVIDE A PENALTY FOR A VIOLATION OF THIS ACT; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The term "all-terrain vehicle," as used in this section, means any motorized vehicle manufactured and designed exclusively for off-road use that travels on three (3), four (4) or more low pressure tires, has a seat designed to be straddled by the operator and uses handlebars for steering control.

     (2)  It shall be unlawful for any person to operate an all-terrain vehicle on any public highway, road or street in this state.  Any person who violates the provisions of this act shall be guilty of a misdemeanor and fined not more than Five Hundred Dollars ($500.00).

     (3)  A parent, guardian or custodian of a minor child shall be financially responsible for the payment of any criminal fines imposed against the minor for a violation of the provisions of subsection (2) of this section.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2003.
