SUB 1 FOR AMEND No. 1 TO AMEND No. 1 PROPOSED TO

                             House Bill NO. 1794

                             By Senator(s) Gordon

     AMEND by adding the following after line 74:

     Provided, however, that the Department of Finance and Administration shall not transfer and the Governor's Office - Division of Medicaid shall not expend or make obligations for medical services in an amount exceeding Two Hundred Four Million Two Hundred Thirty-nine Thousand Seven Hundred Twenty-six Dollars ($204,239,726.00) plus a contingency amount not to exceed fifteen percent (15%) in any month during fiscal year 2003.  Provided further, that in no event shall the Governor's Office - Division of Medicaid make any obligations for medical services which exceed the total level of funds appropriated in this act, and the Executive Director of the Division of Medicaid shall ensure complete compliance with Section 43-13-117, Mississippi Code of 1972, by instituting cost containment measures or by discontinuing authorized Medicaid programs to the extent allowed under federal law.
