REPORT OF CONFERENCE COMMITTEE

 

MADAM PRESIDENT AND MR. SPEAKER:

 

   We, the undersigned conferees, have had under consideration the amendments to the following entitled BILL:

 

S. B. No. 3198:  Appropriation; Department of Education for Minimum Program, additional for FY2002.

 

  We, therefore, respectfully submit the following report and recommendation:

 

 

  1.  That the House recede from its Amendment No. 1.

 

  2.  That the Senate and House adopt the following amendment:

 

     Amend by striking all after the enacting clause and inserting in lieu thereof the following:

    


     SECTION 1.  In addition to all other sums previously appropriated, the following sum, or so much of it as may be necessary, is appropriated out of any money in the Working Cash-Stabilization Reserve Fund created in Section 27-103-203, Mississippi Code of 1972, that is not otherwise appropriated, to the State Department of Education for the purpose of funding the Minimum Education Program for the fiscal year ending

June 30, 2002.................................. $32,678,456.00.

     SECTION 2.  In addition to all other sums previously appropriated, the following sum, or so much of it as may be necessary, is appropriated out of any money in the Working Cash-Stabilization Reserve Fund created in Section 27-103-203, Mississippi Code of 1972, that is not otherwise appropriated, to the State Department of Education for the purpose of funding the Mississippi Adequate Education Program for the fiscal year ending June 30, 2002...................... $ 3,505,554.00.

     SECTION 3.  In addition to all other sums previously appropriated, the following sum, or so much of it as may be necessary, is appropriated out of any money in the Working Cash-Stabilization Reserve Fund created in Section 27-103-203, Mississippi Code of 1972, that is not otherwise appropriated, to the State Department of Education for the purpose of paying annual compensation to the Chickasaw Cession counties for sixteenth section lands which they lost through sale by the state, as provided in Sections 29-3-137 through 29-3-141, Mississippi Code of 1972, for the fiscal year ending June 30, 2002..........................................

............................................... $   518,722.00.

     SECTION 4.  In addition to all other sums previously appropriated, the following sum, or so much of it as may be necessary, is appropriated out of any money in the Working Cash-Stabilization Reserve Fund created in Section 27-103-203, Mississippi Code of 1972, that is not otherwise appropriated, to the State Department of Education for the purpose of funding the Uniform Millage Assistance Grants Program for the fiscal year ending June 30, 2002............... $ 1,070,001.00.

     SECTION 5.  In addition to all other sums previously appropriated, the following sum, or so much of it as may be necessary, is appropriated out of any money in the State General Fund not otherwise appropriated, to the State Department of Education for the purpose of funding the Minimum Education Program for the fiscal year ending June 30, 2002............................... $   12,872,528.00.

     However, the appropriation in this section is contingent upon the transfer of sufficient funds into the State General Fund under Section 27-103-203(4), Mississippi Code of 1972, and the appropriation shall not be made until after the Executive Director of the Department of Finance and Administration has transferred the maximum amount that is authorized to be transferred under Section 27-103-203(4), Mississippi Code of 1972, from the Working Cash-Stabilization Reserve Fund to the State General Fund during the fiscal year ending June 30, 2002.

     SECTION 6.  (1) The additional appropriations in Section 1 and Section 5 of this act are made for the purpose of restoring cuts made by the Governor on February 11, 2002, to the Minimum Education Program.

     (2)  The additional appropriation in Section 2 of this act is made for the purpose of restoring cuts made by the Governor on February 11, 2002, to the Mississippi Adequate Education Program.

     (3)  The additional appropriation in Section 3 of this act is made for the purpose of restoring cuts made by the Governor on February 11, 2002, to the Chickasaw School Fund.

     (4)  The additional appropriation in Section 4 of this act is made for the purpose of restoring cuts made by the Governor on February 11, 2002, to the Uniform Millage Assistance Grants Program.

     SECTION 7.  It is the intention of the Legislature that if any of the cuts made by the Governor on February 11, 2002, are restored to the Department of Education by the Governor for the Minimum Program, Mississippi Adequate Education Program,  Chickasaw Interest budget and the Uniform Millage Assistance Grants Program the State Department of Education shall deposit any and all such funds to the Working Cash-Stabilization Reserve Fund.

     SECTION 8.  The money appropriated by Sections 1 through 4 of this act shall be paid by the State Treasurer out of any money in the Working Cash-Stabilization Reserve Fund that is not otherwise appropriated, and the money appropriated by Section 5 of this act shall be paid by the State Treasurer out of any money in the State General Fund not otherwise appropriated, upon warrants issued by the State Fiscal Officer; and the State Fiscal Officer shall issue his warrants upon requisitions signed by the proper person,


officer or officers in the manner provided by law.

     SECTION 9.  This act shall take effect and be in force from and after its passage.
