AN ACT MAKING A REAPPROPRIATION OF STATE GENERAL FUNDS TO THE STATE DEPARTMENT OF EDUCATION FOR THE PURCHASE OF TEXTBOOKS, CLASSROOM SUPPLIES AND INSTRUCTIONAL MATERIALS FOR SCHOOL DISTRICTS, FOR FISCAL YEAR 2003.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1.  The following sum, or so much thereof as may be necessary, is hereby reappropriated out of any money in the State General Fund not otherwise appropriated to the State Department of Education for the purpose of reauthorizing the expenditure of State General Funds, as authorized in House Bill No. 1611, 2001 Regular Session, for the support and maintenance of the Minimum Education Program, for the fiscal year beginning July 1, 2002, and ending June 30, 2003............................................ $11,188,245.00.

     Notwithstanding the amount reappropriated under the provisions of this section, in no event shall the amount expended exceed the unexpended balance as of June 30, 2002.

     SECTION 2.  This reappropriation is made for the purpose of authorizing the expenditure of State General Funds appropriated in fiscal year 2002 for the support and maintenance of the Minimum Education Program that would lapse into the State General Fund at the end of fiscal year 2002, to make available and restore funds for the purchase of textbooks, classroom supplies and instructional materials at school districts during fiscal year 2003 as authorized under Section 37-61-33.  The Legislature recognizes that the funds reappropriated under the provisions of Section 1 are contingent upon no budget cuts being made by the Governor to the fiscal year 2002 appropriation made in House Bill No. 1611 for the support and maintenance of the Minimum Education Program.  It is the intention of the Legislature that, in the event that it is necessary for the Governor to make cuts to the fiscal year 2002 appropriation made in House Bill No. 1611 for the support and maintenance of the Minimum Education Program, that the amount herein being reappropriated not be subject to any reduction in fiscal year 2002.

     SECTION 3.  The money herein reappropriated shall be paid by the State Treasurer out of any money in the proper fund or funds as set forth in this act, upon warrants issued by the State Fiscal Officer; and the State Fiscal Officer shall issue his warrants upon requisitions signed by the proper person, officer or officers, in the manner provided by law.

     SECTION 4.  This act shall take effect and be in force from and after July 1, 2002.
