AN ACT MAKING AN ADDITIONAL APPROPRIATION FROM SPECIAL FUNDS FOR THE PURPOSE OF DEFRAYING THE EXPENSES OF THE OFFICE OF THE SECRETARY OF STATE FOR FISCAL YEAR 2002.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1.  In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State Treasury to the credit of the Office of the Secretary of State for the purpose of defraying the expenses incurred by said office, for the fiscal year ending June 30, 2002 $    350,000.00.

SECTION 2.  This additional appropriation is made for the purpose of providing spending authority for the Office of the Secretary of State to rebate to Chancery Clerks their portion of Uniform Commercial Code filing fees collected by the Office of the Secretary of State, as authorized in Senate Bill No. 2626, Regular Session of 2001.

     SECTION 3.  It is the intention of the Legislature that the Office of the Secretary of State is hereby authorized to escalate, budget and expend funds from Special Fund No. 3111 in an amount not to exceed One Hundred Thousand Dollars ($100,000.00) in accordance with rules and regulations of the Department of Finance and Administration in a manner consistent with the escalation of federal funds.  The authority granted in this section is provided in the event that amounts required to be rebated to Chancery Clerks for their portion of Uniform Commercial Code filing fees collected by the Office of the Secretary of State in Senate Bill No. 2626, Regular Session of 2001, exceeds the amount appropriated in Section 1 of this act.

     SECTION 4.  The money herein appropriated shall be paid by the State Treasurer out of any money in the proper fund or funds as set forth in this act, upon warrants issued by the State Fiscal Officer; and the State Fiscal Officer shall issue his warrants upon requisitions signed by the proper person, officer or officers in the manner provided by law.

     SECTION 5.  This act shall take effect and be in force from and after its passage.
