AN ACT TO PREEMPT FROM LOCAL GOVERNMENTAL REGULATION THE CREATION OF ANY OFFENSE CONCERNING CELLULAR PHONE USAGE WHILE DRIVING; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The Legislature hereby occupies and preempts the entire field of legislation in this state touching in any way inattentive driving and cellular phone usage in motor vehicles to the complete exclusion of any order, ordinance or regulation by any county, municipality or other political subdivision of this state.  Any existing or subsequently enacted local law, ordinance or regulation in this field is null and void.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
