AN ACT TO AMEND SECTION 49-7-87, MISSISSIPPI CODE OF 1972, TO CLARIFY DUTIES OF THE DEPARTMENT OF WILDLIFE, FISHERIES AND PARKS AND THE DEPARTMENT OF AGRICULTURE AND COMMERCE RELATED TO PERMITS FOR CULTIVATED GAME FISH; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 49-7-87, Mississippi Code of 1972, is amended as follows:

     49-7-87.  (1)  It is unlawful for any person to sell, offer for sale or exchange any game fish enumerated in this chapter whether taken within or coming from without the state. * * *   (2)  The Department of Agriculture and Commerce may issue a permit to the owner of a private pond to sell fish grown or cultivated for stocking purposes only under such regulations as the Department of Agriculture may deem necessary.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2002.
