AN ACT TO CODIFY SECTION 37-19-26, MISSISSIPPI CODE OF 1972, TO PROVIDE AN ALLOTMENT OF MINIMUM EDUCATION PROGRAM AND ADEQUATE EDUCATION PROGRAM FUNDS FOR EMPLOYING PART-TIME LICENSED TEACHERS OR RETIRED TEACHERS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The following provision shall be codified as Section 37-19-26, Mississippi Code of 1972:

     37-19-26.  Beginning with the 2002-2003 school year, in addition to other funds allotted under this chapter, an amount subject to appropriation shall be provided to fund the cost of salaries and fringe benefits of part-time licensed teachers or part-time licensed retired teachers employed by the district for any part of a school day in the elementary or secondary grades.  The State Board of Education shall prescribe the documentation required from a school district on the necessity of employing such part-time teachers or part-time licensed retired teachers, and the State Superintendent of Public Education must approve each part-time teacher or part-time licensed retired teacher employed by the district.  From and after July 1, 2003, the State Department of Education shall include the cost of employing part-time licensed teachers or part-time licensed retired teachers in its determination of base student cost under the adequate education program.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2002.
