AN ACT TO AUTHORIZE THE BOARD OF TRUSTEES OF THE ABERDEEN-MONROE COUNTY HOSPITAL, WITH APPROVAL OF THE BOARD OF SUPERVISORS OF MONROE COUNTY, TO MAKE, ENTER INTO AND APPROVE A CONTRACT FOR MANAGEMENT SERVICES OF THE RESIDENTIAL FACILITY OWNED BY MONROE COUNTY, MISSISSIPPI, AND OPERATED BY THE ABERDEEN-MONROE COUNTY HOSPITAL WITH A TERM OF TEN YEARS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  For the purposes of this act, the following words and phrases shall have the meanings ascribed to them in this section unless the context clearly indicates otherwise:

          (a)  "Board" means the Board of Supervisors of Monroe County, Mississippi.

          (b)  "Board of trustees" means the Board of Trustees of the Aberdeen-Monroe County Hospital.

          (c)  "County" means Monroe County, Mississippi.

          (d)  "Hospital" means the Aberdeen-Monroe County Hospital.

          (e)  "Pioneer" means Pioneer Health Services, Inc.

     SECTION 2.  The Legislature finds that it is in the best interest of the persons living in the area served by the residential facility known as "Personal Place and Garden Suites Assisted Living" within the county to have a private entity manage such residential facility.  The purpose of this act is to authorize the board of trustees, with the approval of the board, to make, enter into and approve a management services contract with Pioneer for the residential facility with a term of up to ten (10) years.

     SECTION 3.  The county and the hospital are vested with all the powers necessary and requisite that are capable of being authorized by the Legislature for the accomplishment of the purposes of this act.  No enumeration of powers in this act impairs or limits any general grant of power contained in this act or limits any grant of power or powers of the same class or classes as those enumerated.  The county and the hospital may both do all acts necessary, proper or convenient in the exercise of the powers granted under this act.

     SECTION 4.  The hospital, acting by and through the board of trustees, with approval of the board, may make, enter into and approve a management services contract with Pioneer for the residential facility for a period of up to ten (10) years.

     SECTION 5.  If any provision of this act is held to be invalid by any court of competent jurisdiction, the remainder of this act shall not be affected by that determination.

     SECTION 6.  This act shall take effect and be in force from and after its passage.
