House Bill 1262

AN ACT TO AMEND SECTION 15-1-45, MISSISSIPPI CODE OF 1972, TO REVISE THE STATUTE OF LIMITATIONS APPLICABLE TO ACTIONS FOUNDED ON FOREIGN JUDGMENTS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 15-1-45, Mississippi Code of 1972, is amended as follows:

     15-1-45.  All actions founded on any judgment or decree rendered by any court of record without this state shall be brought within fifteen (15) years after the rendition of such judgment or decree, and not after.  However, if the person against whom such judgment or decree was or shall be rendered, was, or shall be at the time of the institution of the action, a resident of this state, such action, founded on such judgment or decree, shall be commenced within three (3) years next after the rendition thereof, and not after.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2002.
