House Bill 1203

AN ACT TO PROVIDE A FELONY OFFENSE OF DEFRAUDING PERSONS AGED 55 YEARS OR OLDER; TO PROVIDE PENALTIES FOR VIOLATIONS; TO REQUIRE RESTITUTION; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  In addition to any other penalty provided by law, it shall be unlawful for any contractor or seller of services, equipment or goods to defraud any person over the age of fifty-five (55) by a fraudulent offer of services, equipment or goods.  Any person who violates the provisions of this section shall be guilty of a felony and upon conviction shall be fined Five Thousand Dollars ($5,000.00) or imprisoned for up to five (5) years in the State Penitentiary, or both such fine and imprisonment.  A person convicted under this section shall be ordered to pay full restitution.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2002.
