AN ACT TO REQUIRE AGENCIES AND GOVERNING AUTHORITIES TO BUY COMMODITIES FROM THE MISSISSIPPI INDUSTRIES FOR THE BLIND WHEN THE COMMODITIES MEET THE REQUIREMENTS OF THE AGENCIES AND GOVERNING AUTHORITIES; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The Executive Director of the Mississippi Industries for the Blind shall establish a listing of all commodities provided, manufactured, produced or sold by the Industries for the Blind and shall transmit a copy of the list to the Department of Finance and Administration, each agency and governing authority.

     (2)  Each agency and governing authority shall make purchases or accept bids for such listed commodities provided, manufactured, produced or sold by the Mississippi Industries for the Blind when such commodities are required.

     (3)  The Department of Finance and Administration and the Mississippi Industries for the Blind shall fix a fair market price for all articles offered for sale under authority of this act to determine whether or not articles produced by blind and visually impaired persons meet the reasonable requirements of state agencies and governing authorities and to authorize agencies and governing authorities to purchase articles elsewhere when purchase orders cannot be complied with through Mississippi Industries for the Blind.

     SECTION 2.  Section 1 of this act shall be codified in Chapter 7 of Title 31, Mississippi Code of 1972.

     SECTION 3.  This act shall take effect and be in force from and after July 1, 2002.
