House Bill 814

AN ACT TO PROVIDE THAT IDENTIFYING INFORMATION FOUND IN GARBAGE, LITTER OR RUBBISH IS PRIMA FACIE EVIDENCE OF A VIOLATION OF LAW; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Any identifying documents or other identifying information found in any garbage, litter or rubbish which has been deposited upon private property shall be prima facie evidence of a violation of any applicable garbage, litter, rubbish or solid waste disposal laws.  Law enforcement agencies shall use such identifying documents or other identifying information to bring criminal charges against the persons identified.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2002.
