AN ACT TO AUTHORIZE THE GOVERNING AUTHORITIES OF THE CITY OF OCEAN SPRINGS TO RECONSTITUTE THE MEMBERSHIP OF THE MUNICIPAL PARK COMMISSION; TO PRESCRIBE THE NUMBER OF MEMBERS AND LENGTH OF TERMS OF MEMBERS OF THE RECONSTITUTED COMMISSION; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The governing authorities of the City of Ocean Springs, in their discretion, may reconstitute the membership of the municipal park commission initially created under the authority of Section 21-37-33, Mississippi Code of 1972.  The commission, if reconstituted, shall consist of seven (7) members elected by the governing authorities with one (1) member being elected from each of the seven (7) municipal wards.  The initial terms of office for members of the reconstituted commission shall be one (1) for one (1) year, two (2) for two (2) years, three (3) for three (3) years and one (1) for four (4) years.  The term of office of commission members for all terms subsequent to the initial term shall be four (4) years.  Any member who is serving on the commission at the time that the commission is reconstituted, in the discretion of the governing authorities of the municipality, may be reappointed to the reconstituted commission.

     (2)  The reconstituted commission shall have the same jurisdiction, shall exercise the same powers and duties and, except as otherwise provided under subsection (1) of this section, shall be subject to the same provisions of law as park commissions created under the authority of Sections 21-37-33 through 21-37-43, Mississippi Code of 1972.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
