AN ACT TO PROVIDE THAT TAKING MONEY FROM AN ELDERLY ADULT THROUGH UNDUE INFLUENCE, MISREPRESENTATION, FALSE PRETENSES OR DECEPTION IS A FELONY; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  It shall be unlawful for any person to take money from an elderly adult through undue influence, misrepresentation, false pretenses or deception.

     (2)  Any person who takes One Thousand Dollars ($1,000,00) or more from an elderly adult through undue influence, misrepresentation, false pretenses or deception shall be guilty of a felony and, upon conviction thereof, shall be punished by a fine not to exceed Ten Thousand Dollars ($10,000.00) or by imprisonment not to exceed ten (10) years in the State Penitentiary, or by both such fine and imprisonment.

     (3)  For purposes of this act, "elderly adult" means any adult over sixty (60) years of age.

     (4)  Nothing contained in this section shall prevent proceedings against a person under any statute of this state or municipal ordinance defining any act as a crime, misdemeanor or felony.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
