AN ACT TO REQUIRE THE MISSISSIPPI TRANSPORTATION COMMISSION TO ADOPT A PILOT RIGHT-OF-WAY MANAGEMENT SYSTEM IN KEMPER COUNTY; TO REQUIRE THE COMMISSION TO DETERMINE THE FEASIBILITY OF APPLYING THE PROGRAM ON A STATEWIDE BASIS; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. The Mississippi Transportation Commission shall adopt a pilot program for right-of-way management. The department shall initiate such pilot program in Kemper County. The program shall apply to all rights-of-way of highways on the state system in Kemper County. Under such program, the commission shall dispose of surplus timber on such rights-of-way as provided for in Section 65-1-123, and, once such timber has been disposed of, the Mississippi Department of Transportation shall grade such rights-of-way and plant grass or trees, whichever is appropriate, on such rights-of-way. The commission shall examine the results and cost of the program and, if it so determines, apply the program to the rights-of-way of all highways on the state system.

SECTION 2. This act shall take effect and be in force from and after July 1, 2001.
