AN ACT TO CREATE SECTION 19-3-67, MISSISSIPPI CODE OF 1972, TO ALLOW COUNTIES TO PAY A REASONABLE OFFICE EXPENSE ALLOWANCE TO ANY MEMBER OF THE BOARD OF SUPERVISORS RECEIVING PUBLIC EMPLOYEES RETIREMENT BENEFITS WHERE SUCH MEMBER HAS WAIVED HIS RIGHT TO RECEIVE ALL OTHER SALARY OR COMPENSATION, OTHER THAN REIMBURSEMENT OF TRAVEL EXPENSES; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. The board of supervisors of any county may pay a reasonable office expense allowance to any member of the board of supervisors receiving retirement benefits from the Public Employees' Retirement System, pursuant to Section 25-11-1 et seq., Mississippi Code of 1972, where such person files annually, in writing, with the county and the Public Employees' Retirement System, a waiver of all salary or compensation, other than reimbursement of travel expenses, from the county and elects to receive in lieu of such salary or compensation a retirement allowance as provided in Section 25-11-1 et seq., Mississippi Code of 1972.

SECTION 2. This act shall take effect and be in force from and after July 1, 2001.
