Senate Bill 2403

AN ACT TO CREATE NEW SECTION 87-9-3, MISSISSIPPI CODE OF 1972, TO PROHIBIT CHOICE OF LAW OR CHOICE OF FORUM CLAUSES IN CONTRACTS; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. The following shall be codified as Section 87-9-3, Mississippi Code of 1972:

87-9-3. (1) Any of the following terms of a contract are invalid:

(a) That the law of another state will apply;

(b) That the contracting party consents to the jurisdiction of another state; or

(c) Any term that fixes venue.

(2) The provisions of this section shall apply to all contracts entered into, amended, extended, ratified or renewed on or after July 1, 2001, and shall apply to and be binding upon all successors in interest, purchasers of assets or stock, receivers, trustees or assignees.

SECTION 2. This act shall take effect and be in force from and after July 1, 2001.
