House Concurrent Resolution 9

A CONCURRENT RESOLUTION PROPOSING AN AMENDMENT TO THE MISSISSIPPI CONSTITUTION OF 1890, TO REESTABLISH AND DESCRIBE AS THE OFFICIAL FLAG OF THE STATE OF MISSISSIPPI THAT FLAG WHICH WAS ESTABLISHED AS THE STATE FLAG BY CHAPTER 37, LAWS OF 1894; AND FOR RELATED PURPOSES.

BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI, That the following amendment to the Mississippi Constitution of 1890 is proposed to the qualified electors of the state:

Amend the Mississippi Constitution of 1890 by creating a new section to read as follows:

"SECTION ___. The flag of the State of Mississippi, as established by Chapter 37, Laws of 1894, is hereby reestablished as the official flag of the State of Mississippi, being more particularly described as follows: The flag of the State of Mississippi shall have a width two-thirds (2/3) of its length, with the union square two-thirds (2/3) of the width of the flag. The ground of the union shall be red with a broad blue saltier thereon, bordered with white and emblazoned with thirteen (13) mullets or five-pointed stars, corresponding with the number of the original states of the Union. The field shall be divided into three (3) bars of equal width, the upper one blue, the center one white, and the lower one extending the whole length of the flag, red--the national colors. The staff shall be surmounted with a spearhead and a battle-axe below. The flag shall be fringed with gold, and the staff gilded with gold."

BE IT FURTHER RESOLVED, That this proposed amendment shall be submitted by the Secretary of State to the qualified electors at an election to be held on the first Tuesday after the first Monday of November 2002, as provided by Section 273 of the Constitution and by general law.

BE IT FURTHER RESOLVED, That the explanation of this proposed amendment for the ballot shall read as follows: "This proposed constitutional amendment reestablishes and describes as the official flag of the State of Mississippi that flag as established by Chapter 37, Laws of 1894."
