AN ACT TO AUTHORIZE THE DEPARTMENT OF FINANCE AND ADMINISTRATION, ACTING ON BEHALF OF THE MISSISSIPPI FORESTRY COMMISSION, TO SELL AND CONVEY CERTAIN STATE OWNED REAL PROPERTY LOCATED IN NESHOBA COUNTY, MISSISSIPPI; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. (1) The Department of Finance and Administration, acting on behalf of the Mississippi Forestry Commission, upon meeting the requirements of Section 29-1-1, may sell and convey certain state owned real property and the improvements thereon located in Neshoba County, Mississippi, being more particularly described as follows:

Commence at the SW corner of the NW 1/4 of the NW 1/4 of section 33, Township 9 North, Range 12 East Neshoba County Mississippi, And run Due East 21 feet to a fence corner, said corner being the point of beginning; Thence run due North along a fence 105.0 feet; Thence run due East 210.0 feet; Thence run due South 105.0 feet to a fence on the South line of said 1/4 of 1/4 section; Thence run due West along said fence 210.0 feet to the point of beginning, containing 1/2 acre more or less in the NW 1/4 of NW 1/4 section 33, Township 9 North, Range 12 East Neshoba County Mississippi, Being a part of the Homestead.

The Department of Finance and Administration may have the parcel of property surveyed.

(2) The real property and the improvements thereon described in subsection (1) of this section shall be sold for not less than the current fair market value as determined by the averaging of at least two (2) appraisals by qualified appraisers who shall be selected by the Department of Finance and Administration and shall be certified and licensed by the Mississippi Real Estate Appraiser Licensing and Certification Board.

(3) The State of Mississippi shall retain all mineral rights to the real property sold and conveyed under this section.

(4) The proceeds from the sale and conveyance of the real property and improvements thereon described in subsection (1) of this section shall be used first to reimburse the Department of Finance and Administration for any costs incurred by the department regarding the sale and conveyance, and the remaining proceeds from such sale and conveyance shall be used by the Mississippi Forestry Commission to escalate its budget in the Other Than Equipment category for the purchase of real estate to be used by the Mississippi Forestry Commission in the performance of its powers and duties.

SECTION 2. This act shall take effect and be in force from and after its passage.
