AN ACT TO PROHIBIT THE USE OR POSSESSION OF CERTAIN RODENTICIDES CONTAINING STRYCHNINE; TO PROVIDE PENALTIES FOR VIOLATIONS OF THIS ACT; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. (1) No person shall use or possess a rodenticide known as "Martin's Gopher Bait 50" or any other rodenticide containing strychnine. For purposes of this act, the term "rodenticide" means any substances or mixture of substances intended for preventing, destroying, repelling or mitigating rodents. Nothing herein prevents the use of strychnine by licensed physicians and veterinarians for medicinal purposes.

(2) A person violating subsection (1) of this section is guilty of a misdemeanor and, upon conviction, shall be punished by a fine not to exceed One Thousand Dollars ($1,000.00). If such person has also violated the provisions of Section 69-23-1 et seq., or any rules or regulations promulgated thereunder, he is subject to the penalties provided in Section 69-23-29 or Section 69-23-135 in addition to the fine provided in this subsection.

SECTION 2. This act shall take effect and be in force from and after July 1, 2001.
