AN ACT TO AUTHORIZE THE DEPARTMENT OF FINANCE AND ADMINISTRATION, ACTING ON BEHALF OF THE MISSISSIPPI FORESTRY COMMISSION, TO PURCHASE CERTAIN REAL PROPERTY AND THE IMPROVEMENTS THEREON, LOCATED IN GREENE COUNTY, MISSISSIPPI; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. (1) The Department of Finance and Administration, acting on behalf of the Mississippi Forestry Commission, may purchase from Joshua Timberlands, LLC, certain real property and the improvements thereon, located in Greene County, Mississippi, and being more particularly described as follows:

Commence at the southwest corner of Section 33, Township 3 North, Range 6 West, thence North 47 feet to north edge of old Mississippi Highway No. 24, thence 2,094 feet in a northeasterly direction along the north edge of old Mississippi Highway No. 24 to a point of beginning at the junction of said Highway No. 24 and Mississippi Highway No. 63, thence South 58° West 330 feet along north edge of said Highway No. 24, thence North 16° West 271 feet, thence North 60° East 330 feet, thence South 16° East 264 feet along west edge of right of way of said Highway No. 63 to point of beginning and containing in all two acres, more or less, and being situated in the southeast Quarter of Southwest Quarter of Section 33, Township 3 North, Range 6 West.

(2) The Department of Finance and Administration may purchase the real property and the improvements thereon described in subsection (1) of this section on such terms and conditions agreed upon by the Department of Finance and Administration and Joshua Timberlands, LLC, to be in the best interests of both parties. However, the Department of Finance and Administration shall not purchase such real property and the improvements thereon for more than the current fair market value as determined by the averaging of at least two (2) appraisals by qualified appraisers who shall be selected by the Department of Finance and Administration and shall be certified and licensed by the Mississippi Real Estate Appraiser Licensing and Certification Board.

(3) The Department of Finance and Administration may obtain appraisals of the property, abstracts and surveys and engage the services of attorneys to conduct the transaction described in this section. The department may obtain title insurance on the real property if it determines that the best interests of the department would be served. The Mississippi Forestry Commission shall reimburse the Department of Finance and Administration for costs incurred by the department under this subsection (3).

SECTION 2. This act shall take effect and be in force from and after its passage.
