AN ACT TO AMEND SECTION 97-29-31, MISSISSIPPI CODE OF 1972, TO PROVIDE FOR FELONY INDECENT EXPOSURE IN CERTAIN CASES; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. Section 97-29-31, Mississippi Code of 1972, is amended as follows:

97-29-31. (1) A person who willfully and lewdly exposes his person, or private parts thereof, in any public place, or in any place where others are present, or procures another to so expose himself, is guilty of a misdemeanor and, on conviction, shall be punished by a fine not exceeding Five Hundred Dollars ($500.00) or be imprisoned not exceeding six (6) months, or both.

(2) Any person over the age of twenty-one (21) years who shall willfully and for the purpose of gratifying his or her lust or indulging his or her licentious sexual desires lewdly exposes his or her person or the private parts thereof to the view of a minor under the age of sixteen (16) years; or any such adult person who compels or causes a person under the age of sixteen (16) years of age to expose their person or the private parts thereof to the view of the person over the age of twenty-one (21) years for the purpose of the adult person to gratify his or her lust, or to indulge his or her depraved licentious sexual desires; then such adult shall be punished by a fine not exceeding Ten Thousand Dollars ($10,000.00) or be imprisoned in the Penitentiary for a term not exceeding ten (10) years, or both.

SECTION 2. This act shall take effect and be in force from and after its passage.
