House Bill 153

AN ACT TO PROVIDE THAT CONDOMS SHALL NOT BE SOLD TO PERSONS UNDER THE AGE OF EIGHTEEN YEARS WITHOUT A PRESCRIPTION; TO PROVIDE PENALTIES FOR VIOLATIONS OF THIS ACT; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. (1) It shall be unlawful to sell condoms to any minor under the age of eighteen (18) years unless such minor has a prescription from a licensed physician. Any person or entity who violates the provisions of this section shall be subject to a fine of Five Thousand Dollars ($5,000.00). Any adult who purchases a condom for a minor shall be subject to a fine of One Thousand Dollars ($1,000.00).

(2) Any retail business selling condoms shall require proof of age to sell condoms.

SECTION 2. This act shall take effect and be in force from and after July 1, 2001.
