AMENDMENT No. 1 PROPOSED TO

Amend by striking all after the enacting clause and inserting in lieu thereof the following:

SECTION 1. (1) The mileage of highway specifically designated in subsection (2) of this section is in addition to the total mileage limitation of eight thousand six hundred (8,600) miles that is set out in Section 65-3-3.

(2) The following highways are designated as state highways and are placed under the jurisdiction of the Mississippi Transportation Commission and such highways, together with the highways designated in Sections 65-3-3 and 65-3-5, and all other laws adding links to the designated state highway system, are declared to be the state highway system of Mississippi: Central District - Rankin County:

Mississippi 468 - Beginning at Mississippi 25 in the City of Flowood, thence south to U.S. 80, thence in a southeasterly direction to Whitfield and thence in a northeasterly direction to or near the City of Brandon, all in Rankin County.

Mississippi 249 - Beginning at Mississippi 475 in the City of Flowood thence south to U.S. 80 connecting to U.S. 49, all in Rankin County.

(3) The Mississippi Department of Transportation is authorized to construct, maintain, take over and assume jurisdiction of the highways described in this section; provided, however, that in lieu of actually bringing any current roads up to the standards of the Mississippi Department of Transportation, the City of Flowood, the City of Pearl and Rankin County shall provide necessary engineering and rights-of-way, including utility adjustments and movements. Once the necessary engineering and rights-of-way, including utility adjustments and movements are provided for Mississippi 249, the Mississippi Department of Transportation shall provide funds for construction of a four-lane (or five-lane where needed) road from Fourth Street in the City of Flowood to Mississippi 475, a distance of approximately two and two-tenth (2.2) miles.

SECTION 2. (1) The mileage of highway specifically designated in subsection (2) of this section is in addition to the total mileage limitation of eight thousand six hundred (8,600) miles that is set out in Section 65-3-3.

(2) The following highway is designated as a state highway and is placed under the jurisdiction of the Mississippi Transportation Commission for construction and maintenance; and

such highway, together with the highways designated in Sections 65-3-3 and 65-3-5, and all other laws adding links to the designated state highway system, are declared to be the state highway system of Mississippi:

Southern District - Jones County:

Mississippi 590 - Beginning at Mississippi 11 and extending easterly to Mississippi 29, a distance of approximately 1.3 miles.

(3) The Mississippi Transportation Commission shall maintain, construct, take over and assume jurisdiction of the highway designated in subsection (2) of this section in the same manner and upon the same terms and conditions as set out in Sections 65-1-75, 65-3-3, 65-9-1 and 65-9-3.

SECTION 3. (1) The mileage of highway specifically designated in subsection (2) of this section is in addition to the total mileage limitation of eight thousand six hundred (8,600) miles that is set out in Section 65-3-3.

(2) The following highway is designated as a state highway and is placed under the jurisdiction of the Mississippi Transportation Commission for construction and maintenance; and such highway, together with the highways designated in Sections 65-3-3 and 65-3-5, and all other laws adding links to the designated state highway system, are declared to be the state highway system of Mississippi:

Central District - Newton County:

Decatur Street beginning on the north side of the intersection of Third Street and Decatur Street, and proceeding northward to the beginning of state maintenance south of U.S. Highway 80, all within the City of Newton.

(3) The Mississippi Transportation Commission shall maintain, construct, take over and assume jurisdiction of the highway designated in subsection (2) of this section in the same manner and upon the same terms and conditions as set out in Sections 65-1-75, 65-3-3, 65-9-1 and 65-9-3. However, the City of Newton shall not be required to provide to the Mississippi Department of Transportation any right-of-way with a width any greater than the width of right-of-way that existed at the time that the highway segment described in subsection (2) of this section was returned to the jurisdiction of the City of Newton.

SECTION 4. The following highways are deleted from the state highway system, removed from the jurisdiction of the Mississippi Transportation Commission and returned to the jurisdiction of the governing authorities of the City of Newton:

Central District - Newton County:

(a) That section of Old Mississippi Highway 15 beginning south of Interstate 20 at the intersection of Old Mississippi Highway 15 and present Mississippi Highway 15 and extending southwesterly for approximately .033 miles, all within the City of Newton; and

(b) That section of Old Mississippi Highway 15 located between U.S. Highway 80 and Decatur Street, all within the City of Newton.

SECTION 5. This act shall take effect and be in force from and after July 1, 2000.

Further, amend by striking the title in its entirety and inserting in lieu thereof the following:

AN ACT TO DESIGNATE CERTAIN SEGMENTS OF HIGHWAY IN RANKIN COUNTY AS STATE HIGHWAYS AND TO PLACE SUCH SEGMENTS UNDER THE JURISDICTION OF THE MISSISSIPPI TRANSPORTATION COMMISSION FOR CONSTRUCTION AND MAINTENANCE; TO PROVIDE THAT IN LIEU OF BRINGING ANY CURRENT ROADS UP TO THE STANDARDS OF THE MISSISSIPPI DEPARTMENT OF TRANSPORTATION, THE CITY OF FLOWOOD, THE CITY OF PEARL AND RANKIN COUNTY SHALL PROVIDE NECESSARY ENGINEERING AND RIGHTS-OF-WAY, INCLUDING UTILITY ADJUSTMENTS AND MOVEMENTS; TO PROVIDE THAT THE DEPARTMENT OF TRANSPORTATION SHALL PROVIDE FUNDS FOR THE CONSTRUCTION OF FOUR LANES (OR FIVE LANES WHERE NEEDED) OF CERTAIN PORTIONS OF SUCH SEGMENTS ONCE SUCH ENGINEERING AND RIGHTS-OF-WAY ARE PROVIDED; TO DESIGNATE A CERTAIN ADDITIONAL SECTION OF HIGHWAY IN JONES COUNTY AS A PART OF THE STATE HIGHWAY SYSTEM AND TO PLACE IT UNDER THE JURISDICTION OF THE MISSISSIPPI TRANSPORTATION COMMISSION; TO DESIGNATE A CERTAIN ADDITIONAL SEGMENT OF HIGHWAY IN NEWTON COUNTY AS A PART OF THE STATE HIGHWAY SYSTEM AND TO PLACE IT UNDER THE JURISDICTION OF THE MISSISSIPPI TRANSPORTATION COMMISSION; TO DELETE TWO SEGMENTS OF HIGHWAY IN NEWTON COUNTY FROM THE STATE HIGHWAY SYSTEM AND TO RETURN THEM TO THE JURISDICTION OF THE CITY OF NEWTON; AND FOR RELATED PURPOSES.
