REPORT OF CONFERENCE COMMITTEE

MR. PRESIDENT AND MR. SPEAKER:

We, the undersigned conferees, have had under consideration the amendments to the following entitled BILL:

S. B. No. 3247: Appropriation; Tax Commission.

We, therefore, respectfully submit the following report and recommendation:

 

1. That the House recede from its Amendment No. 1.

2. That the Senate and House adopt the following amendment:

 

Amend by deleting lines 18 through 49 and inserting in lieu thereof the following:

and ending June 30, 2001 $ 43,697,773.00.

SECTION 2. The following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the special fund in the State Treasury to the credit of the State Tax Commission which are collected by or otherwise become available for the purpose of defraying the expenses of the commission for the fiscal year beginning July 1, 2000, and ending June 30,

2001 $ 5,162,171.00.

SECTION 3. Of the funds appropriated under the provisions of Sections 1 and 2, not more than the amounts set forth below shall be expended for the respective major objects or purposes of expenditure:

AMEND further by inserting a new Section 12 and a new Section 13 and renumbering subsequent sections, said new sections to read as follows:

SECTION 12. The following sum, or so much thereof as may be necessary, is hereby reappropriated out of any money in the State General Fund not otherwise appropriated, to the State Tax Commission from State General Funds authorized in Senate Bill No. 3127, Regular Session of 1999, for the purpose of defraying the expenses of the State Tax Commission, for the fiscal year beginning July 1, 2000, and ending June 30, 2001

$ 800,000.00.

Notwithstanding the amount reappropriated under the provisions of this section, in no event shall the amount expended exceed the unexpended balance as of June 30, 2000.

SECTION 13. Of the funds appropriated under the provisions of Section 2, the following sum is provided for the purpose of refunding income taxes that were overpaid by Randolph Holmes,

$518.00.

This additional appropriation is for the purpose of refunding income taxes that were overpaid by Randolph Holmes, who properly applied for and was properly paid an income tax refund for the tax

year 1993, but did not realize the tax refund due to failure to timely cash the warrant for the refund.
