REPORT OF CONFERENCE COMMITTEE

MR. SPEAKER AND MR. PRESIDENT:

We, the undersigned conferees, have had under consideration the amendments to the following entitled BILL:

H. B. No. 1383: State Parole Board; abolish the terms of office of members and extend the date of the repealer for two years.

We, therefore, respectfully submit the following report and recommendation:

 

1. That the Senate recede from its Amendment No. 1.

2. That the House and Senate adopt the following amendment:

 

AMEND on lines 15 and 16 by striking the words ", one (1) from each congressional district".

AMEND further by inserting a period at the end of line 20 and by deleting line 21 in its entirety.

AMEND further on line 35 by striking the entire sentence after the period.

AMEND further by inserting after line 63 the following and by renumbering the succeeding section:

(7) The State Parole Board, immediately after the effective date of this act, shall review all cases where an offender was denied parole and any eligibility for reconsideration for parole for at least one (1) year after denial.

(8) The State Parole Board shall review and investigate all cases where offenders have been diagnosed with a serious illness. If the Medical Director of the Department of Corrections certifies to the State Parole Board that an offender is suffering from a terminal illness, the State Parole Board shall parole the offender with the approval and consent of the Commissioner of the Department of Corrections and the medical director.

AMEND further on line 66 by striking "July 1, 2000" and inserting "its passage".

AMEND further the title by inserting after the semicolon on line 7 the following:

TO PROVIDE THAT THE STATE PAROLE BOARD IMMEDIATELY SHALL REVIEW ALL CASES WHERE AN OFFENDER WAS DENIED PAROLE AND ANY ELIGIBILITY FOR RECONSIDERATION FOR PAROLE FOR AT LEAST ONE YEAR AFTER DENIAL; TO PROVIDE THAT AN OFFENDER DIAGNOSED WITH A TERMINAL ILLNESS SHALL BE RELEASED ON PAROLE SUBJECT TO THE APPROVAL AND CONSENT OF THE COMMISSIONER OF THE DEPARTMENT OF CORRECTIONS AND THE MEDICAL DIRECTOR OF THE DEPARTMENT OF CORRECTIONS;
