REPORT OF CONFERENCE COMMITTEE

MR. SPEAKER AND MR. PRESIDENT:

We, the undersigned conferees, have had under consideration the amendments to the following entitled BILL:

H. B. No. 1280: Medicaid; division shall educate managed care program participants about manner to seek care under.

We, therefore, respectfully submit the following report and recommendation:

 

1. That the House concur in Senate Amendment No. 1 with the following exception(s):

 

AMEND by inserting the following after the word "Session," on line 26: "and House Bill No. 1432, 2000 Regular Session,"

AMEND FURTHER by deleting lines 46 through 54 and inserting in lieu thereof the following:

"(c) Hospitals will receive an additional payment for the implantable programmable pump implanted in an inpatient basis. The payment pursuant to written invoice will be in addition to the facility's per diem reimbursement and will represent a reduction of costs on the facility's annual cost report, and shall not exceed Ten Thousand Dollars ($10,000.00) per year per recipient. * * * This paragraph (c) shall stand repealed on July 1, 2001."

AMEND FURTHER on line 137 by inserting the following after the word "implement": ", not later than January 1, 2001,"

AMEND FURTHER by inserting the following language after the period on line 420:

"From and after July 1, 2000, the division is authorized to contract with a 134-bed specialty hospital located on Highway 39 North in Lauderdale County for the use of not more than sixty (60) beds at the facility to provide mental health services for children and adolescents and for crisis intervention services for emotionally disturbed children with behavioral problems, with priority to be given to children in the custody of the Department of Human Services who are, or otherwise will be, receiving such services out-of-state."

AMEND FURTHER on line 609 by deleting the word "physicians'"

AMEND FURTHER by inserting the following after line 633:

"(43) The division shall provide reimbursement, according to a payment schedule developed by the division, for smoking cessation medications for pregnant women during their pregnancy and other Medicaid-eligible women who are of child-bearing age."

AMEND FURTHER by deleting lines 671 and 672 and inserting in lieu thereof the following:

"SECTION 2. It is the intent of the Legislature that the amendments to Section 43-13-117, Mississippi Code of 1972, contained in this House Bill No. 1280, 2000 Regular Session, shall supersede the amendments to this section contained in House Bill No. 1432, 2000 Regular Session.

SECTION 3. This act shall take effect and be in force from and after its passage."

AMEND FURTHER by striking the title in its entirety and inserting in lieu thereof the following:

"AN ACT TO AMEND SECTION 43-13-117, MISSISSIPPI CODE OF 1972, TO CLARIFY THE PROVISION AUTHORIZING MEDICAID REIMBURSEMENT TO HOSPITALS FOR IMPLANTABLE PROGRAMMABLE PUMPS; TO PROVIDE THAT IF THE DIVISION OF MEDICAID PROVIDES MANAGED CARE SERVICES TO MEDICAID RECIPIENTS, THE DIVISION SHALL BE RESPONSIBLE FOR EDUCATING THE PARTICIPANTS IN THE MANAGED CARE PROGRAM REGARDING THE MANNER IN WHICH THEY SHOULD SEEK HEALTH CARE UNDER THE PROGRAM; TO DELETE THE AUTHORITY OF THE DIVISION TO OPERATE A CAPITATED MANAGED CARE PROGRAM; TO AUTHORIZE THE DIVISION TO CONTRACT WITH A CERTAIN HOSPITAL TO PROVIDE MENTAL HEALTH AND CRISIS INTERVENTION SERVICES FOR CHILDREN AND ADOLESCENTS; TO CLARIFY THE SERVICES ELIGIBLE FOR REIMBURSEMENT FOR DUALLY ELIGIBLE BENEFICIARIES; TO AUTHORIZE MEDICAID REIMBURSEMENT FOR AN OBSTETRICAL CARE PROGRAM FOR LOW BIRTH WEIGHT AND PRE-TERM BABIES; TO AUTHORIZE MEDICAID REIMBURSEMENT FOR SMOKING CESSATION

MEDICATIONS FOR PREGNANT WOMEN AND OTHER WOMEN OF CHILD-BEARING AGE; AND FOR RELATED PURPOSES."

2. That the Senate concur in the above exception(s).
