AN ACT TO AUTHORIZE THE GOVERNING AUTHORITIES OF THE CITY OF HOLLY SPRINGS, MISSISSIPPI, TO EXPAND ITS NATURAL GAS, WATER AND SEWER SYSTEM WITHIN A CERTAIN AREA OUTSIDE THE CORPORATE LIMITS OF THE CITY OF HOLLY SPRINGS; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. (1) Notwithstanding any provisions of Section 21-27-39, Mississippi Code of 1972, to the contrary, the governing authorities of the City of Holly Springs, Mississippi, in their discretion, may construct, expand, operate and maintain the natural gas, water and sewer system of the City of Holly Springs in the following described areas within Marshall County, outside the corporate limits of the City of Holly Springs:

A TRACT OF LAND BEING 6400 ACRES MORE OR LESS ALL IN THE NORTH PART OF MARSHALL COUNTY, MISSISSIPPI AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:

ALL SECTION 1 TOWNSHIP 2 SOUTH, RANGE 4 WEST;

SECTION(S) 24, 25, AND 36 TOWNSHIP 1 SOUTH, RANGE 4 WEST;

ALL OF SECTION 13, TOWNSHIP 1 SOUTH, RANGE 4 WEST, IN THE

STATE OF MISSISSIPPI;

ALL OF SECTIONS 17, 18 & THE WEST 1/2 SECTION 16, TOWNSHIP 1

SOUTH, RANGE 3 WEST, ALL IN THE STATE OF MISSISSIPPI;

ALL OF SECTIONS 19, 20 TOWNSHIP 1 SOUTH, RANGE 3 WEST;

WEST 1/2 SECTION 21, TOWNSHIP 1 SOUTH, RANGE 3 WEST;

N.W. 1/4 SECTION 28, TOWNSHIP 1 SOUTH, RANGE 3 WEST;

ALL OF SECTION 30, TOWNSHIP 1 SOUTH, RANGE 3 WEST, LESS AND

EXCEPT THE EAST 1/2 OF THE S.E. 1/4 OF SAID SECTION 30,

TOWNSHIP 1 SOUTH, RANGE 3 WEST;

ALL OF SECTION 31, TOWNSHIP 1 SOUTH, RANGE 3 WEST, LESS AND

EXCEPT THE EAST 1/2 OF THE EAST 1/2 OF SAID SECTION

31, TOWNSHIP 1 SOUTH, RANGE 3 WEST;

ALL SECTION 6, TOWNSHIP 2 SOUTH, RANGE 4 WEST LESS AND EXCEPT THE EAST 1/2 OF THE EAST 1/2 OF SAID SECTION 6, TOWNSHIP 2 SOUTH, RANGE 4 WEST;

Whenever such gas, water and sewer service is furnished to any consumer residing outside the corporate limits of the City of Holly Springs, the consumer may not be charged at a rate greater than twice the rate charged for the same service within the corporate limits of the City of Holly Springs.

(2) The authority conferred by this act shall not be construed as an exemption from the provisions of Section 77-3-1 et seq., Mississippi Code of 1972, as to the requirements for obtaining a Certificate of Public Convenience and Necessity, the jurisdiction of the Mississippi Public Service Commission to regulate rates or any other provisions of that law.

SECTION 2. This act shall take effect and be in force from and after its passage.
