AN ACT MAKING ADDITIONAL APPROPRIATIONS FROM THE CRIMINAL JUSTICE FUND TO THE OFFICE OF THE ATTORNEY GENERAL FOR THE PURPOSE OF DEFRAYING THE COSTS OF CERTAIN EXPERT WITNESS FEES, ATTORNEY FEES, JUDGMENTS AND SETTLEMENT AGREEMENTS INCURRED BY THE OFFICE OF THE ATTORNEY GENERAL AND AGAINST THE STATE OF MISSISSIPPI, FOR FISCAL YEAR 2000.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the Criminal Justice Fund No. 3086 not otherwise appropriated, for the purpose of defraying the expenses of the Office of the Attorney General for the fiscal year ending June 30, 2000 $ 286,394.00.

This additional appropriation is made for the purposes of defraying the costs of certain outside legal assistance and expert witness fees incurred by the Office of the Attorney General.

SECTION 2. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the Criminal Justice Fund No. 3086 not otherwise appropriated, for the purpose of paying a judgment rendered against the State of Mississippi for the fiscal year ending June 30, 2000 $ 5,262.00.

This additional appropriation is made for the purpose of paying a court ordered judgment in Case No. 1998-CA-01198-SCT, Trial Court Case No. G98573; Mississippi Gaming Commission v. Tupelo Industries, Inc., in the Supreme Court of Mississippi.

SECTION 3. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the Criminal Justice Fund No. 3086 not otherwise appropriated, for the purpose of paying a judgment rendered against the State of Mississippi, for the fiscal year ending June 30, 2000 $ 72,761.00.

This additional appropriation is made for the purpose of paying a court ordered judgment as required in Civil Action No. 3:95-CV-640WS, Deposit Guaranty National Bank v. George Dale, in his official capacity as Commissioner of the Mississippi Department of Insurance, in the United States District Court, Southern District of Mississippi, Jackson Division.

SECTION 4. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the Criminal Justice Fund No. 3086 not otherwise appropriated, for the purpose of paying a judgment rendered against the State of Mississippi, for the fiscal year ending June 30, 2000 $ 163,289.00.

This additional appropriation is made for the purpose of paying a court ordered judgment as required in Civil Action No. 2:90-CV-43WS, Johnny Dupree, et al. v. Mike Moore, Attorney General of Mississippi, in his official capacity, and the State of Mississippi, in the United States District Court, Southern District of Mississippi, Jackson Division.

SECTION 5. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the Criminal Justice Fund No. 3086 not otherwise appropriated, for the purpose of paying a judgment rendered against the State of Mississippi for the fiscal year ending June 30, 2000 $ 2,553.00.

This additional appropriation is made for the purpose of paying a court ordered judgment as required in Civil Action No. 3:77-CV-47B American Civil Liberties Union of Mississippi, et al. v. Kirk Fordice in the United States District Court, Southern District of Mississippi, Jackson Division.

SECTION 6. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the Criminal Justice Fund No. 3086 not otherwise appropriated, for the purpose of paying a judgment rendered against the State of Mississippi, for the fiscal year ending June 30, 2000 $ 87,621.00.

This additional appropriation is made for the purpose of paying a court ordered judgment as required in Civil Action No. 3:96CV596BN Pro Choice Mississippi, et al. v. F. E. Thompson, in his official capacity as State Health Officer, et al. in the United States District Court, Southern District of Mississippi, Jackson Division.

SECTION 7. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the Criminal Justice Fund No. 3086 not otherwise appropriated, for the purpose of paying a judgment rendered against the State of Mississippi, for the fiscal year ending June 30, 2000 $ 24,973.00.

This additional appropriation is made for the purpose of paying a court ordered judgment as required in Civil Action No. S92-0529(R)(R) in the United States District Court, Southern District of Mississippi, Jackson Division and Appeal No. 96-60434 in the United States Court of Appeals for the Fifth Circuit, Shanika Shonta Bush Ellis, et al. v. Helen Wetherbee, in her official capacity as Executive Director of the Mississippi Division of Medicaid.

SECTION 8. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the Criminal Justice Fund No. 3086 not otherwise appropriated, for the purpose of paying a judgment rendered against the State of Mississippi, for the fiscal year ending June 30, 2000 $ 2,030.00.

This additional appropriation is made for the purpose of paying a court ordered judgment as required in Cause No. 1999-SA-00240-COA, Department of Finance and Administration, a State Agency v. Lee Andrew Reese and Mississippi Employee Appeals Board in the Court of Appeals of the State of Mississippi.

SECTION 9. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the Criminal Justice Fund not otherwise appropriated, for the purpose of paying a settlement against the State of Mississippi, for the fiscal year ending June 30, 2000 $ 157,225.00.

This additional appropriation is made for the purpose of paying a settlement in Civil Action No. 3:99CV271BN, Robert King v. Mississippi Board of Animal Health, et al. in the United States District Court, Southern District of Mississippi, Jackson Division.

SECTION 10. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the Criminal Justice Fund not otherwise appropriated, for the purpose of paying a judgment rendered against the State of Mississippi, for the fiscal year ending June 30, 2000 $ 6,051.00.

This additional appropriation is made for the purpose of paying a court ordered judgment as required in Civil Action No. 5:99cv80BrS, Eugenia Walker and Margarite Owen v. Claude Poole and Members of the Yazoo County Election Commission, in the United States District Court, Southern District of Mississippi, Jackson Division.

SECTION 11. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the Criminal Justice Fund not otherwise appropriated, for the purpose of paying a judgment rendered against the State of Mississippi, for the fiscal year ending June 30, 2000 $ 3,737.00.

This additional appropriation is made for the purpose of paying a court ordered judgment as required in Civil Action No. G-99-1356 O/3, Alberta Butler v. Department of Mental Health, Mississippi State Hospital in the Chancery Court of the First Judicial District of Hinds County, Mississippi.

SECTION 12. The money herein appropriated shall be paid by the State Treasurer out of any money in the proper fund or funds as set forth in this act, upon warrants issued by the State Fiscal Officer; and the State Fiscal Officer shall issue his warrants upon requisitions signed by the proper person, officer or officers, in the manner provided by law.

SECTION 13. This act shall take effect and be in force from and after its passage.
