AN ACT TO PROVIDE FOR THE PROHIBITION OF SMOKING IN THE NEW CAPITOL BUILDING; TO PROVIDE FOR THE POSTING OF NONSMOKING SIGNS IN THE NEW CAPITOL BUILDING; TO PROVIDE FOR ENFORCEMENT OF THIS ACT; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. (1) "Smoking" means inhaling, exhaling, burning, carrying any lighted cigar or cigarette. Smoking shall be prohibited in all enclosed public places within the New Capitol Building, including, but not limited to, the following places:

(a) Elevators.

(b) Rest rooms, lobbies, reception areas, hallways and any other common-use areas.

(c) All areas available to and customarily used by the general public, including every room, chamber, public meeting or public assembly area.

(2) The New Capitol Building shall have posted at every entrance a conspicuous sign clearly stating that smoking is prohibited.

(3) All ashtrays and other smoking paraphernalia shall be removed from any area where smoking is prohibited by this act by the legislative committee or state agency having control of such area.

(4) Enforcement of this act shall be implemented by the Capitol Police force with the assistance of the appropriate legislative committee or state agency.

SECTION 2. This act shall take effect and be in force from and after July 1, 2000.
