House Concurrent Resolution 37

A CONCURRENT RESOLUTION TO CREATE A NEW JOINT RULE 41 TO PROHIBIT SMOKING IN THE AREAS OF THE NEW CAPITOL BUILDING THAT ARE UNDER THE JURISDICTION OF THE HOUSE AND THE SENATE; TO PROVIDE FOR ENFORCEMENT OF THIS RULE BY THE SERGEANTS AT ARMS OF THE HOUSE AND THE SENATE; AND FOR RELATED PURPOSES.

BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF THE STATE OF MISSISSIPPI, THE SENATE CONCURRING THEREIN, That the 2000-2004 Joint Rules of the Senate and the House are amended by creating a new Joint Rule 41 to read as follows:

"41. (1) No person shall smoke in the areas of the New Capitol Building that are under the jurisdiction of the House and the Senate.

(2) The Sergeants at Arms of the House and the Senate shall not permit smoking in the areas of the New Capitol Building that are under the jurisdiction of the House and the Senate, and shall use reasonable efforts to prevent smoking in those areas of the New Capitol Building, including, but not limited to, the following:

(a) Posting appropriate signs informing state employees, invitees, guests and other persons that smoking is prohibited in those areas of the New Capitol Building; and

(b) Securing the removal of persons who smoke in those areas of the New Capitol Building.

(3) As used in this rule, the term "smoke" or "smoking" means to inhale, exhale, burn, carry or otherwise possess any lighted cigarette, cigar, pipe or any other object or device of any form that contains lighted tobacco or any other smoking product."
