AN ACT TO AUTHORIZE THE GOVERNING AUTHORITIES OF THE CITY OF SOUTHAVEN, MISSISSIPPI, TO CONTRACT OR ENTER INTO A LEASE WITH A LAND DEVELOPER FOR THE PURPOSES OF CONSTRUCTING, OPERATING AND MAINTAINING A MULTIPURPOSE SPORTS FACILITY ON LAND OWNED BY THE CITY OF SOUTHAVEN; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. The governing authorities of the City of Southaven, Mississippi, in their discretion, may enter into and contract with a land developer for the purposes of constructing, operating and maintaining a multipurpose sports facility on land owned by the City of Southaven. Such contract may be executed in the form of a lease not to exceed twenty-five (25) years in duration, shall be operated in accordance with all applicable parks and recreation policies and procedures promulgated and adopted by the governing authorities of the City of Southaven and shall be subject to such additional terms and conditions as the parties may agree. Such contract or lease shall remain valid, binding and enforceable during its entire term by or against the parties to such contract or lease and their assignees or successors in office, according to the terms and conditions of the contract or lease. Upon expiration of the contract or lease, the facility and all of its improvements, fixtures and accoutrements shall be conveyed and inure to the ownership, benefit and use of the City of Southaven.

SECTION 2. This act shall take effect and be in force from and after its passage.
