House Bill 1551

AN ACT MAKING AN APPROPRIATION TO THE STATE DEPARTMENT OF HEALTH FOR THE PURPOSE OF PROVIDING FUNDS FOR HIV/AIDS EDUCATION, PREVENTION AND TREATMENT PROGRAMS AND SERVICES FOR THE FISCAL YEAR 2001.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. The following sum, or so much of it as may be necessary, is appropriated out of any money in the State General Fund not otherwise appropriated, to the State Department of Health for the purpose of providing funds for HIV/AIDS education, prevention and treatment programs and services, as provided in Section 2 of this act, for the fiscal year beginning July 1, 2000, and ending June 30, 2001 ...........................$7,000,000.00.

SECTION 2. (1) The money appropriated in Section 1 of this act shall be expended by the State Department of Health as follows:

(a) Outreach services, including statewide education on prevention of HIV/AIDS..............................$3,000,000.00.

(b) AIDS Drug Assistance Program (ADAP), provide state funding for.........................................$1,000,000.00.

(c) Housing for people with AIDS (HOPWA), provide state funding for.........................................$1,000,000.00.

(d) Assistance to the Southern AIDS Commission, Inc. and other community-based organizations in Public Health District III to provide technical assistance, provide for expansion of education on causes and prevention of HIV/AIDS, and provide a regional delivery service to persons infected with HIV............ ....................................................$1,000,000.00.

(e) Assistance to community-based organizations in Public Health District V to provide for expansion of education on causes and prevention of HIV/AIDS and provide a regional

delivery service to persons infected with HIV.........$500,000.00.

(f) Assistance to community-based organizations in Public Health District IX to provide for expansion of education on causes and prevention of HIV/AIDS and provide a regional delivery service to persons infected with HIV..................$500,000.00.

(2) Any funds appropriated by this act that are not expended by the end of the fiscal year shall not lapse into the State General Fund.

(3) Funds authorized for community-based organizations under this act shall be provided in the form of grants made by the State Department of Health. Funds provided to community-based organizations under this act shall be overseen by a committee of providers and consumers appointed by the State Department of Health, with representation from Public Health Districts III, V and IX.

SECTION 3. The money appropriated by this act shall be paid by the State Treasurer out of any money in the State General Fund not otherwise appropriated, upon warrants issued by the State Fiscal Officer; and the State Fiscal Officer shall issue his warrants upon requisitions signed by the proper person, officer or officers in the manner provided by law.

SECTION 4. This act shall take effect and be in force from and after July 1, 2000.
