AN ACT TO AUTHORIZE EVERY CERTIFIED LAW ENFORCEMENT OFFICER, UPON RETIREMENT, TO RETAIN, WITHOUT COST AND AS HIS PERSONAL PROPERTY, ONE SIDEARM ISSUED TO HIM BY THE STATE, COUNTY, MUNICIPALITY OR POLITICAL SUBDIVISION BY WHICH HE WAS EMPLOYED IF THE SIDEARM IS FIVE YEARS OLD OR OLDER; TO AMEND SECTIONS 45-3-51 AND 45-9-131, MISSISSIPPI CODE OF 1972, IN CONFORMITY WITH THE PROVISIONS OF THIS ACT; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. Every law enforcement officer employed by the state, a county, a municipality or any other political subdivision of the state who is certified under Chapter 6 of Title 45, Mississippi Code of 1972, by the Board on Law Enforcement Officer Standards and Training, upon retirement under any state retirement system or any state-approved retirement system for superannuation or for reason of disability, shall be allowed to retain without cost, as his personal property, one (1) sidearm that was issued to him by the state, county, municipality or political subdivision if the sidearm is five (5) years old or older.

SECTION 2. Section 45-3-51, Mississippi Code of 1972, is amended as follows:

45-3-51. Notwithstanding the provisions of Section 1 of House Bill No. , 2000 Regular Session, each member of the Mississippi Highway Safety Patrol or agent of the Mississippi Bureau of Narcotics who retires under the Highway Safety Patrol Retirement System or the Public Employees' Retirement System, for superannuation or for reason of disability shall be allowed to retain, as his personal property, one (1) sidearm which was issued under authority of Section 45-3-19 or 41-29-159.

SECTION 3. Section 45-9-131, Mississippi Code of 1972, is amended as follows:

45-9-131. Notwithstanding the provisions of Section 1 of House Bill No. , 2000 Regular Session, upon approval of the governing authorities of the municipality or county, a member of any municipal or county law enforcement agency who retires under any state retirement system or any state-approved retirement system may be allowed to purchase as his personal property one (1) sidearm which was issued to him by the law enforcement agency from which he retired. The governing authorities of the municipality or county shall determine the amount to be paid for the firearm by the retiring member of the law enforcement agency.

SECTION 4. This act shall take effect and be in force from and after July 1, 2000.
