House Bill 1471

AN ACT TO AUTHORIZE THE DEPARTMENT OF FINANCE AND ADMINISTRATION, ACTING ON BEHALF OF THE MISSISSIPPI DEPARTMENT OF CORRECTIONS, TO PURCHASE CERTAIN REAL PROPERTY, AND THE IMPROVEMENTS THEREON, LOCATED IN GREENE COUNTY, MISSISSIPPI; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. (1) The Department of Finance and Administration, acting on behalf of the Mississippi Department of Corrections, may purchase from the Kimberly-Clark Company certain real property, and the improvements thereon, located in Greene County, Mississippi, and being more particularly described as follows:

PARCEL 1

Commencing at the SW corner of SW 1/4 of SW 1/4 of said Section 33; thence run north 66.20 feet to the north right-of-way line of Leakesville-Neely Road (Old Hwy 24); thence run along said right-of-way line N6520'47"E 470.12 feet to point of beginning; thence run N0121'01"E 719.52 feet; thence run N7100'08"E 1324.01 feet to the west right-of-way line of MS State Hwy 63; thence run along said right-of-way S1521'22"E 321.46 feet to the intersection of the north right-of-way of Leakesville-Neely Road (Old Hwy 24); thence run along the north right-of-way line of Leakesville-Neely Road (Old Hwy 24) S2121'09"W 121.06 feet; thence run along said right-of-way S5657'38"W 578.33 feet; thence run along a curved section of said right-of-way to the right having a radius of 2993.51 feet and a chord bearing and distance of S6054'18"W 394.17 feet; thence run along said right-of-way S6520'47"W 528.87 feet back to the point of beginning.

Said Parcel No. 1 contains 18.13 acres. Subject to a lease contract to the Mississippi Forestry Commission made and entered into on the 5th day of August, 1975.

PARCEL 1-A

Commencing at the SW corner of the SW corner of the SW 1/4 of the SW 1/4 of said Section 33; thence run north 66.20 feet to the north right-of-way line of the Leakesville-Neely Road (Old Hwy 24); thence run along said right-of-way N6520'47"E 998.99 feet; thence run along said right-of-way along a curved section to the left having a radius of 2993.51 feet and a chord bearing and distance of N6054'18"E 394.17 feet; thence run along said right-of-way N5657'38"E 324.28 feet to the point of beginning; thence run N1619'01"W 277.46 feet; thence run N5951'00"E 330 feet to the west right-of-way line of MS State Hwy 63; thence run along said right-of-way S1521'22"E 187.46 feet to the intersection with the north right-of-way of Leakesville-Neely Road (Old Hwy 24); thence run along said right-of-way S2121'09"W 121.06 feet; thence run S5657'38"W 254.05 feet back to the point of beginning.

Parcel 1-A contains 1.90 acres as per survey (2.00 acres as per deed).

(2) The Department of Finance and Administration may purchase the real property, and the improvements thereon, described in subsection (1) of this section on such terms and conditions agreed upon by the Department of Finance and Administration and the Kimberly-Clark Company, to be in the best interests of both parties.

(3) The Department of Finance and Administration may obtain appraisals of the property, abstracts and surveys and engage the services of attorneys to conduct the transaction described in this section. The department may obtain title insurance on the real property if it determines that the best interest of the department would be served.

SECTION 2. This act shall take effect and be in force from and after its passage.
