House Bill 1270

AN ACT TO REPEAL SECTION 49-15-35, MISSISSIPPI CODE OF 1972, WHICH AUTHORIZES THE COMMISSION ON MARINE RESOURCES TO PROHIBIT THE TAKING OF MENHADEN WITHIN CERTAIN DISTANCES OF THE COASTLINE ONLY IF REQUESTED TO DO SO BY THE BOARDS OF SUPERVISORS OF THE COASTAL COUNTIES; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. Section 49-15-35, Mississippi Code of 1972, which authorizes the Commission on Marine Resources to prohibit the taking and catching of menhaden within certain limits of the coastline of the county so requesting, and which disallows the commission from setting such limits without the request of the boards of supervisors of the respective coastal counties, is repealed.

SECTION 2. This act shall take effect and be in force from and after July 1, 2000.
